Shift Happens - Terms and Conditions

These Terms and Conditions constitute a legally binding agreement between you, the user, and Shifthappensapp, the provider of the Shift Happens mobile application. By downloading, installing, or using the app, you acknowledge and agree to be bound by these Terms and Conditions. This contract takes effect from the moment you first use the app.

Users must not input confidential, private, or patient-identifiable data into the app. Users agree to keep any account login details secure and must not attempt to misuse, reverse-engineer, or exploit the app in any way. Privacy policy can be viewed separately within the app.

4. Our Responsibilities and Liability

We will take reasonable steps to keep the app secure and operational. Data is hosted using secure servers with encryption. However, we do not accept liability for loss of data, errors, app downtime, or any damages arising from reliance on the app. We make no guarantees that the app will be error-free or meet your individual needs.

5. Intellectual Property

All content within the app, including but not limited to code, branding, logos, designs, and other materials, are owned by Shifthappensapp. Users are granted a non-exclusive, non-transferable, personal licence to use the app for its intended purpose only. Any unauthorised use, reproduction, or distribution is prohibited.

6. Payments and Subscriptions

The app is currently provided free of charge, but will consist of third-party services such as Google AdMob for advertisements and Google Analytics for administration purposes. No payments or subscriptions are required at this time. If payments or subscriptions are introduced in the future, clear terms regarding pricing, renewal, and cancellation will be provided, and these Terms and Conditions will be updated accordingly.

7. Termination

We reserve the right to suspend or terminate user accounts that breach these Terms and Conditions. Users may delete their account and associated data at any time by contacting us at Shifthappensbusinessuk@gmail.com, or using the in-app account deletion function.

8. Disclaimers

The app is intended for personal shift management purposes only. It is not designed to be used as evidence in employment disputes and should not be relied upon as the sole record of your working hours. We accept no responsibility for missed shifts, scheduling issues, or employment-related claims arising from the use of this app.

9. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

10. Updates to Terms

We may update these Terms and Conditions from time to time. Users will be notified of any significant changes within the app or by email. Continued use of the app after changes take effect constitutes acceptance of the new Terms and Conditions.
